The service is provided "as-is" and "as available." We do not guarantee uninterrupted access, nor do we warrant that the service will be free from errors, viruses, or other harmful components. Consequences & Data Policy
Violation of these terms may result in immediate termination of access, suspension of accounts, and forfeiture of associated data. We reserve the right to report illegal activities to relevant authorities.
Data Retention
Upon account termination, MarkVex reserves the right to retain certain data for security, legal, and operational integrity purposes, as detailed in our Privacy Policy.
We've structured these terms to minimize friction for genuine users while maintaining a defensive perimeter against abuse. The key trade-offs:

What is the liability cap for service outages?
Our liability is limited to the amount you paid in the preceding 12 months, or 100 USD, whichever is greater. This aligns with industry standard for SaaS & gaming tools.
Who owns the content generated using MarkVex tools?
You retain ownership of your original assets and data. MarkVex retains rights to the underlying platform, API structures, and aggregated, anonymized data for improvement.
Can I use MarkVex for commercial game development?
Yes, for creating games. However, reselling the MarkVex platform itself or its core components is prohibited. See our License Agreement for commercial tiers.
What happens to my data if MarkVex ceases operations?
We provide a 90-day notice period. During this time, a data export tool will be available. We do not promise perpetual storage—back up your work locally.
How are user disputes mediated?
Primarily through internal ticketing. For unresolved issues involving third parties or significant damages, arbitration clauses apply per Section 8.
Is reverse-engineering ever permitted?
Only if expressly authorized in writing for interoperability testing. Unauthorized decompilation is a direct violation leading to immediate account termination.
